Introduction. Welcome to Pet Pros Services Inc.(www.petproservices.com) Thanks for stopping by. By accessing Pet Pros Services Inc. you are agreeing to the following terms, which are designed to make sure that Pet Pros Services Inc. works for everyone. This policy is effective 1/01/2014.

Using Pet Pros Services Inc.. You will post in the appropriate category or area and will not do any of the following bad things:
•    violate any laws or the Pet Pros Services, Inc. Policies
•    be false or misleading;
•    infringe any third-party right;
•    distribute or contain spam, chain letters, or pyramid schemes;
•    distribute viruses or any other technologies that may harm Pet Pros Services Inc. or the interests or property of Pet Pros Services Inc. users;
•    impose an unreasonable load on our infrastructure or interfere with the proper working of Pet Pros Services Inc.;
•    copy, modify, or distribute any other person’s content without their consent;
•    harvest or otherwise collect information about others, including email addresses, without their consent;
•    bypass measures used to prevent or restrict access to Pet Pros Services Inc..

Abusing Pet Pros Services Inc. Please use the flagging system to tell us about any problems or offensive content so that together we can keep the site working properly. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Pet Pros Services Inc. if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Pet Pros Services Inc. or not, we do not accept any liability for monitoring Pet Pros Services Inc. or for unauthorized or unlawful content on Pet Pros Services Inc. or use of Pet Pros Services Inc. by users.

Fees and Services. Using Pet Pros Services Inc. is NOT FREE. We provide professional services and charge for the following. Rehoming Pets, Adopting Pets, Home Boarding Care, Finding Your Perfect, etc. Our fees are quoted on the service page under fees. Please read them before you post your pet. Our fees are listed in  USA Dollars, and we may change them from time to time. Our fees are non-refundable, and you are responsible for paying them when they’re due. If you don’t, we will limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).

I also understand that all sales are final for ALL of PET Pros services. Pet Pros Services does not make any guarantees on any pet adopted or sales made.  Pet Pros Services simply finds new homes for pets and are not the owners of these pets. Any injury, harm, or accident caused by the pet  are not the liability of Pet Pros Services Inc.  By using any form on this site online or downloadable you are agreeing to these terms. I understand that Pet Pros Services does not guarantee to find my pet a new home. They will do their very best. I will not ask for a refund or seek to get a refund from Pet Pros Services legally or in any other manner from any of the services provided. I understand that Pet Pros Services has no control over who adopts my pet, boards my pet, etc. and will not be held liable and will not give any refund if my pet is not placed.

Content. Pet Pros Services Inc. contains stuff from us, you, and other users. You agree not to copy, modify, or distribute Pet Pros Services Inc., our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe that your rights have been violated, please notify our designated copyright agent at Pet Pros Services Customer Support regarding the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party’s rights.
Personal Information. By using Pet Pros Servicesi, you agree to the collection, transfer, storage and use of your personal information by Marktplaats BV (the “data controller”) on servers located in the United States, and in the European Union as further described in our privacy policy.

Infringement. Do not post content that infringes the rights of third parties, This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or of any party’s rights.  If you believe that your rights have been violated, please notify Customer Support, Pet Pros Services Inc.’s designated agent for notice of claims of copyright or other intellectual property infringement at:

Please provide the following in any notice of alleged infringement (whether sent through the above email address or through the postal address):
•    identification of the material on Pet Pros Services Inc. that you claim is infringing, with enough detail so that we may locate it on the website (e.g. the unique ad number);
•    identification of the rights (or works if relevant) claimed to have been infringed;
•    a statement by you that you have a good faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;
•    a statement by you declaring under penalty of perjury that
(a) the above information in your notice is accurate, and
(b) that you are the rights owner or you are authorized to act on behalf of that rights owner;
•    your address, telephone number, and email address; and
•    your physical or electronic signature.

Liability. You agree not to hold us responsible for things other users post or do. As most of the stuff on Pet Pros Services Inc. comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Pet Pros Services Inc., even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

THIRD PARTY CONTENT, SITES, AND SERVICES
The Pet Pros site and Content available through the Service may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of Pet Pros including web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole.  Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals.  You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that Pet Pros Services shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Pet Pros Services is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Pet Pros Services, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

DISCLAIMER OF WARRANTIES

YOU AGREE THAT USE OF THE PET PROS SERVICES SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE PET PROS SERVICES SITE AND THE SERVICE ARE PROVIDED ON AN “AS IS” OR “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND.  ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.  TO THE FULLEST EXTENT PERMITTED BY LAW, PET PROS SERVICES DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE PET PROS SERVICES SITE AND THE SERVICE.  TO THE FULLEST EXTENT PERMITTED BY LAW, PET PROS SERVICES DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE PET PROS SERVICES SITE OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON THE PET PROS SERVICES SITE.  TO THE FULLEST EXTENT PERMITTED BY LAW, PET PROS SERVICES DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE PET PROS SERVICES SITE OR THE SERVICE.  Some jurisdictions do not allow the disclaimer of implied warranties.  In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.

LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL PET PROS SERVICES BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF PET PROS SERVICES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE PET PROS SERVICES SITE OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE PET PROS SERVICES SITE OR THE SERVICE, FROM INABILITY TO USE THE PET PROS SERVICES SITE OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE PET PROS SERVICES SITE OR THE SERVICE.  SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PET PROS SERVICES SITE OR THE SERVICE OR ANY LINKS ON THE PET PROS SERVICES SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PET PROS SERVICES SITE OR THE SERVICE OR ANY LINKS ON THE PET PROS SERVICES SITE.  THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, limitations of liability are not permitted.  In such jurisdictions, some of the foregoing limitation may not apply to you.

INDEMNITY

You agree to indemnify and hold Pet Pros Services, its officers, subsidiaries,
affiliates, successors, assigns, directors, officers, agents, service
providers, suppliers and employees, harmless from any claim or demand,
including reasonable attorney fees and court costs, made by any third party
due to or arising out of Content you submit, post or make available through
the Service, your use of the Service, your violation of the Termos ou use, your
breach of any of the representations and warranties herein, or your
violation of any rights of another.

We may update this agreement at any time, with updates taking effect when you next use the site or after 30 days, whichever is sooner.
